By registering and using the J Billo platform as a Buyer, you expressly agree to the following terms and conditions:
1. Registration and Approval
All internet Buyers must provide the information required by J Billo in order to be approved. If you intend to pay with a Company Check, you must provide a Bank Letter of Guarantee prior to bidding. The letter must state: “We will guarantee the payment of checks on account [Account Number] for [Customer Name] up to [Specify Amount] dollars for purchases at J Billo auctions. We hereby agree that no stop payment will be issued.”
2. Buyer's Premium and Fees
- Buyer’s Premium: The Buyer will pay a 10% Buyer's Premium on the hammer price (winning bid amount).
- Internet Purchase Fee: As a special launch promotion, the standard 2% internet platform fee is waived (0%).
- Documentation Fee: A flat administrative fee of $100.00 per lot will be charged for all vehicles, trucks, or equipment requiring a legal transfer of ownership (Title).
3. Sales Tax (Florida)
J Billo is required to collect the Florida State Sales Tax (6%) plus any applicable county discretionary sales surtax on all purchases picked up locally. Out-of-state buyers, exporters, dealers, or farmers will only be tax-exempt if they provide J Billo with official exemption forms (Florida Annual Resale Certificate, Agricultural Exemption) or a valid Bill of Lading proving interstate/international freight by a common carrier, prior to the final invoice issuance.
4. Payments
Payment in full must be made within 48 hours of the auction's close. Accepted forms of payment are: Cash, Wire Transfer, Cashier’s Check, or a Company Check accompanied by a bank letter of guarantee.
5. Removal and Storage Fees
- Removal Deadline: All purchased lots must be removed from the J Billo yard (located at 8411 Florida Georgia Hwy, Havana, FL, 32333) within 7 calendar days following the auction date.
- Storage Fee: If the equipment is not removed within this period, a storage fee of $25.00 per day, per lot, will be charged starting on the 8th day until the actual date of removal. Equipment will only be released upon full payment of the invoice and any accrued storage fees.
6. “As-Is, Where-Is” Condition and Responsibilities
- Each and every lot is sold “As-Is, Where-Is.” J Billo provides no guarantees or warranties whatsoever, express or implied, regarding the operation, year, hours, or condition of the items.
- Catalog descriptions are based on information from sellers and constitute opinions only, not facts. Buyers waive any claims against J Billo related to description errors.
- Risk of Loss: The Buyer is responsible for insuring the purchased equipment against all losses from the moment the auctioneer declares the item sold (hammer falls). J Billo bears no responsibility for the equipment after it is sold.
- Bidding: All bids are irrevocable. If your bidder number is used to win a lot, you are financially liable for the payment without protest.
7. Inspection
All auction assets are available for in-person inspection before the auction closes. Our team is available to answer questions and provide access to the equipment during scheduled inspection hours.
- Inspection by appointment.
- Equipment can be started (when applicable).
- Photos and videos are available online. Additional information is available upon request. By placing a bid, the Buyer agrees that all items are sold AS-IS, WHERE-IS.
8. Default / Failure to Pay
If payment in full is not received within the required 48 hours, J Billo reserves the right, at its sole discretion, to: (a) cancel the sale and retain any deposits made by the Buyer as liquidated damages; (b) resell the lot at a future auction or private sale, holding the defaulting Buyer liable for any deficiency (shortfall) in price, plus lost commissions and costs; and (c) permanently ban the Buyer from the platform.
9. Loading & Rigging
The Buyer is solely responsible for arranging freight, rigging, and the safe transport of the equipment. J Billo staff may provide basic loading assistance as a courtesy but assumes no liability for any damages to the equipment, transport vehicles, or personal injuries occurring during the loading process at the yard.
10. Minimum Age
By registering and bidding on the J Billo platform, the user represents and warrants that they are at least 18 (eighteen) years of age and have the legal capacity to form a binding contract.
11. Bid Disputes
The highest bidder for each lot shall be the Buyer. In the event of any dispute, J Billo shall have absolute discretion to determine the successful bidder or to re-offer the lot for sale.
12. Governing Law and Jurisdiction
These Terms and Conditions shall be strictly governed by and construed in accordance with the laws of the State of Florida. By participating in the auction, the user agrees that any legal dispute or cause of action arising from the use of the J Billo platform, or the purchase/sale of lots, shall be resolved exclusively in the competent courts located within the State of Florida.
