Seller Terms and Conditions

These terms apply when equipment is accepted and a consignment is formalized. Sending an initial seller inquiry does not accept these terms, create a contract, or guarantee acceptance.

By consigning equipment and vehicles for sale at J Billo auctions, the Seller expressly agrees to the following terms, fees, and conditions:

1. Seller's Commission

The commission charged by J Billo will be deducted from the final hammer price, based on the Seller's total sales volume at the event:

  • Total sales under $50,000: 10% commission on the final price.
  • Total sales of $50,000 or more: Reduced 5% commission on the final price.

2. Reserve Price, No-Sale Fee, and Listing Fee

  • Reserve Price: The Seller has the right to establish a confidential minimum reserve price. If the highest bid does not meet this amount, the equipment will not be sold.
  • No-Sale Fee: If the item is not sold exclusively because the reserve price was not met, J Billo will charge the Seller an administrative fee of 2% of the highest bid achieved during the auction.
  • Upfront Listing Fee: The Seller shall pay an upfront administrative listing fee per lot (varying from $25 to $100 based on the equipment category: $25 for small items/parts, $50 for light equipment, and $100 for heavy machinery) at the time of consignment. Special Condition: If the lot is successfully sold, the entire Listing Fee paid will be refunded or deducted from the final commission owed to J Billo.

3. Make-Ready Services

To maximize the sale value, J Billo will perform lot preparation for a flat fee of $150.00 per equipment. This fee covers detailed washing and a professional photo session for the online catalog, which will be deducted from the Seller's final settlement payout.

4. Hauling Services

The Seller is responsible for delivering the equipment to the J Billo yard (located at 8411 Florida Georgia Hwy, Havana, FL, 32333). If the Seller requires logistical assistance, J Billo offers custom hauling and towing services. Costs vary based on weight, dimensions, and distance, and will be quoted on demand at the time of contract signing.

5. Settlement Statement / Payout

The net payout owed to the Seller (hammer price minus the fees expressly described in these Seller Terms, plus any additional services disclosed in advance and authorized in writing by the Seller) will be issued by J Billo within 10 to 15 business days after the auction closes.

  • Essential Condition: The payout is strictly conditional upon J Billo’s receipt and bank clearance of the Buyer’s payment in full, as well as the Seller delivering all required legal documentation and free-and-clear titles.

6. Lien & Storage Fee

  • Right of Lien: J Billo retains a lien on all consigned machinery. No unsold equipment will be released from the Havana, FL yard without full payment of all outstanding fees (No-Sale Fee, Make-Ready, and Hauling).
  • Storage Fee: The Seller has 7 calendar days after the auction to remove any unsold equipment. Starting on the 8th day, a storage fee of $25.00 per day, per lot, will apply.

7. Bid Disputes

In the event of any bidding dispute, J Billo shall have absolute discretion to determine the successful bidder or to re-offer the lot for sale.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be strictly governed by and construed in accordance with the laws of the State of Florida. By consigning items, the Seller agrees that any legal dispute or cause of action arising from the use of the J Billo platform, or the purchase/sale of lots, shall be resolved exclusively in the competent courts located within the State of Florida.
